  •                 Investigation Update
    
        The investigation of the physical evidence from the scene and the statements continue to be consistent with the presence of David P. Gatti at 2205 C20 as being unanticipated by the resident and his identity being unknown to the resident at the time of the event.  Mr. Gatti’s entry to the residence was without permission.  His continued presence was without the consent and threatening in nature.  As the event evolved, his behavior became assaultive.

        The investigation information has been reviewed by the investigators, me and the Office of District Attorney William M. Bennett. The available investigative data shows that the control, possession, and use of the firearm was defensive in nature and consistent with Massachusetts General Laws.  Based upon all of the current data, the investigation is being continued with the determination the discharge of the firearm was in a lawful defense of personal safety.

        The investigation has been most timely because of the full cooperation of the principle parties, the family of Mr. Gatti, witnesses and neighbors.

        The investigation is being continued with the assistance of the Office of the Medical Examiner.

        At this time no criminal complaints are pending.
